These Terms & Conditions (“Terms”) govern (a) your use of the website moroccomosaictours.com and any related social-media pages, and (b) all tour services provided by moroccomosaictours, headquartered at M’Hamid Marrakesh, Morocco (“we”, “us”, “our”).By accessing the Site or booking a tour, you agree to be bound by these Terms. If you do not accept them, please do not use the Site or make any reservation.
1 – Definitions:
“Client”, “you”, “your” = the person who views the Site, makes a reservation or participates in a tour.“Services” = all tours, activities, transfers, add-ons and related support offered by us.“Supplier” = any independent third party (e.g., driver, camel handler, accommodation, restaurant) engaged by us to help deliver the Services.
2 – Booking & Payment :
Reservation request : Bookings are made via our online form, email, WhatsApp, phone or authorised partners (e.g., Viator, GetYourGuide).A booking is confirmed only after we issue a written confirmation and receive the required deposit or full payment.
Prices & currency:
1.All prices are quoted in euros (€) or Moroccan dirhams (MAD) unless stated otherwise.
2.Prices are per person and include VAT/TVA and any local taxes known at the time of booking.
Payment methods:
1.We accept major credit or debit cards via our secure gateway, cash in Moroccan dirhams upon arrival (if pre-approved), or bank transfer.
3.You are responsible for any bank or card processing fees charged by your provider.
Outstanding balance:
1.If only a deposit is paid, the balance is due on the date, and in the manner, stated in your confirmation email.
2.Failure to pay the balance on time may result in cancellation and forfeiture of the deposit (see section 5).
3 – Client Responsibilities:
1.Provide accurate contact details, group size and medical or dietary needs.
2.Arrive on time at the agreed pick-up point; late arrival may reduce tour time or be treated as a “no-show”.
3.Hold valid travel documents (passport, visas) and appropriate travel insurance.
4.Follow the instructions of guides and Suppliers; respect local customs and environmental rules.
5.Accept that activities such as quad biking, camel riding or desert trekking involve inherent risks.
4 – Our Responsibilities
Deliver the Services with reasonable skill, care and safety.
Select competent drivers, guides and Suppliers and monitor their performance.
Hold the licences and insurance required by Moroccan law for passenger transport and tour operation.

5 – Cancellations & Refunds
By the Client
Up to 72 hours before the tour: full refund minus any non-recoverable Supplier costs.
72 to 24 hours before the tour: 50 % of the total price is forfeited.
Less than 24 hours or no-show: no refund.
By us
We may cancel due to unsafe weather, force majeure (section 9) or insufficient participants (minimum 2, unless a private tour is booked).
You may choose a rescheduled date or receive a full refund; this is our sole liability.
Third-party marketplaces
If you booked through Viator, GetYourGuide or other partners, their cancellation rules may apply instead of, or in addition to, ours.
6 – Changes & Flexibility
Minor route or timing changes may occur due to traffic, weather or operational factors and do not entitle you to compensation.
Major changes (e.g., replacing a key activity) will be communicated as soon as practicable; you may accept the change or cancel for a full refund.
7 – Liability & Risk Acknowledgement
Assumption of risk
Adventure activities involve hazards including, but not limited to, rough terrain, dust, altitude, heat and equipment failure. By participating, you accept such risks.
Limitation of liability
We are liable only for direct losses caused by our proven negligence and up to the amount you paid for the Service in question.
We are not liable for indirect or consequential loss (e.g., missed flights, lost profits) or for acts/omissions of third-party Suppliers beyond our control.
Personal property
Keep valuables with you; we do not accept liability for theft, loss or damage unless caused by our negligence.
8 – Travel Insurance
You are strongly advised to hold comprehensive insurance covering medical expenses, personal accident, cancellation and personal belongings. Proof of insurance may be requested.
9 – Force Majeure
Neither party is liable for failure to perform due to events beyond reasonable control, including natural disasters, war, riots, pandemic restrictions, strikes or government orders. If force majeure occurs, we will offer rescheduling where feasible or a credit note valid for 12 months.
10 – Intellectual Property
All text, photos, videos, logos and graphics on the Site are owned by or licensed to moroccomosaictours. You may view and print pages for personal, non-commercial use only. Any other use requires prior written consent.
11 – Links & Third-Party Content
Our Site may contain links to external sites we do not control. We are not responsible for their content, privacy practices or any loss arising from their use.
12 – Complaints
Notify your guide immediately so we can attempt an on-the-spot solution.
If unresolved, email a detailed complaint to Omar.eladnani10@gmail.com within 7 days of the tour.
We will investigate and reply within 14 days.
13 – Governing Law & Jurisdiction
These Terms are governed by Moroccan law. Any dispute not resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Marrakesh, Morocco.
14 – Updates to These Terms
We may amend these Terms to reflect legal updates or service changes. The version posted on the Site at the time of booking applies to your contract.
